(referred to as “Company”, “we”, “us”, or “our”), you agree to comply with and be legally bound by these Terms of Service (“Terms”). If you do not agree with any part of these Terms, you must immediately discontinue use of our Site and services. These Terms apply to all visitors, users, policyholders, and others who access our services.
To purchase any insurance product or receive a binding quote, you must be at least 20 years of age and have the legal capacity to contract under Thai law. You agree to provide accurate, current, and complete information during registration or when filling out any application form. You are solely responsible for maintaining the confidentiality of your account credentials (if any). The Company reserves the right to refuse service, terminate accounts, or cancel policies if information provided is found to be false, misleading, or incomplete.
All insurance products displayed on our Site are subject to specific policy terms, conditions, exclusions, and limitations as described in the individual policy wordings. Any quote provided online or through our advisors is an estimate and does not constitute a binding offer. Final premium amounts and coverage are determined after underwriting assessment based on the information you provide. We reserve the right to accept, decline, or adjust any insurance application in accordance with our underwriting guidelines and OIC (Office of Insurance Commission) regulations.
Descriptions of coverage are summaries only and do not replace the official policy contract. In case of any discrepancy between these Terms and the policy document, the policy document shall prevail.
Premium payments must be made in Thai Baht (THB) via approved payment methods (credit card, bank transfer, QR code, or over-the-counter). Policies become effective only after the Company has received the full premium payment and issued a confirmation. Late or non-payment may result in policy lapse, cancellation, or denial of claims. You agree to pay all applicable taxes, fees, and surcharges associated with your policy. Automatic renewal terms, if applicable, will be disclosed at the time of purchase. You may opt out of auto-renewal in writing at least 30 days before the renewal date.
To file a claim, you must notify the Company as soon as reasonably possible (within 7 days of the incident for motor claims; within 15 days for health and property claims). You are required to submit all supporting documents (police reports, medical certificates, repair estimates) as requested. The Company aims to settle eligible claims within 48 hours after receiving complete documentation. However, delays may occur due to verification or third-party investigations. Fraudulent claims will result in immediate policy cancellation, forfeiture of premiums, and legal action under Thai criminal law.
Policyholder Cancellation: You may cancel a policy within the “free-look period” of 15 days from policy issuance, provided no claims have been filed. A pro-rated refund (less administrative fees) will be issued. After the free-look period, cancellation may be subject to short-period rates as defined in the policy schedule. Company Cancellation: We may cancel your policy for non-payment of premiums, material misrepresentation, or fraud with 30 days written notice. Refunds, if any, will be calculated according to OIC regulations.
You agree not to misuse our website or services. Prohibited activities include: (a) attempting to gain unauthorized access to our systems; (b) uploading malicious code or viruses; (c) scraping or data mining our content without permission; (d) submitting false information or impersonating another person; (e) interfering with the proper functioning of the Site. Any violation may result in termination of access and legal liability.
Your privacy is critical to us. Our collection, use, and storage of personal data are governed by our Privacy Policy and the Personal Data Protection Act B.E. 2562 (PDPA). By using our services, you consent to the processing of your personal data for underwriting, claims, customer support, and regulatory compliance. You have the right to access, correct, or request deletion of your data as described in our Privacy Policy.
All content on the Site — including text, graphics, logos, icons, images, software, and the “Pueantae Insurance” trademark — is the exclusive property of Pueantae Insurance Co., Ltd. or its licensors and is protected by Thai and international copyright laws. You may not reproduce, distribute, modify, publicly display, or create derivative works without our prior written consent. Unauthorized use may result in civil and criminal penalties.
To the fullest extent permitted by law, Pueantae Insurance Co., Ltd., its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site, inability to obtain coverage, or any claim denial except as expressly provided in your policy contract. In any event, our total liability shall not exceed the amount of premium you paid in the 12 months preceding the claim. This limitation does not apply to liability for death, personal injury, or fraud.
You agree to indemnify, defend, and hold harmless the Company and its officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to (a) your breach of these Terms; (b) your violation of any law or third-party rights; (c) any misrepresentation made in your insurance application; or (d) your misuse of the Site or services.
These Terms and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of Thailand. Any dispute arising from or relating to these Terms, your insurance policy, or our services shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved within 60 days, it shall be submitted to the exclusive jurisdiction of the courts of Bangkok, Thailand. For insurance-related disputes, you may also file a complaint with the Office of Insurance Commission (OIC) mediation process.
We reserve the right to update or modify these Terms at any time without prior notice to reflect changes in laws, our practices, or regulatory requirements. The revised version will be posted on this page with an updated “Last Updated” date. Your continued use of our Site or services after any changes constitutes acceptance of the new Terms. Material changes will be notified via email or website banner when reasonably possible.
